Terms of Use
The short version. The Off-Leash Oracle is a whimsical, for-entertainment daily message about dogs and trail life. It is not veterinary, medical, behavioral, legal, financial, or professional advice, and it is not a prediction of the future. Enjoy it as a bit of morning fun, and always use your own judgment — and a real professional — for decisions about your dog or yourself. Full terms below.
1. Acceptance of these Terms
These Terms of Use ("Terms") are a binding agreement between you and Joy, Thee & Me LLC, a Texas limited liability company ("we," "us," "our"), governing your access to and use of offleashoracle.com and the daily-message service (together, the "Service"). By visiting the site, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. What the Oracle is (and what it is not)
The Off-Leash Oracle delivers short, playful "cosmic dog wisdom" — a daily reading meant to entertain, amuse, and gently inspire. It is provided for entertainment and novelty purposes only.
The Oracle is NOT, and must not be relied upon as:
- Veterinary or medical advice — for your dog or for you. Always consult a licensed veterinarian for animal health and a qualified professional for human health.
- Animal-behavior or training advice — consult a qualified trainer/behaviorist for behavioral concerns.
- Legal, financial, safety, or other professional advice.
- A prediction, forecast, or statement of fact about future events or outcomes.
Readings are generated from a curated collection of light-hearted messages and do not take into account your individual circumstances. Any action you take based on a reading is at your own discretion and risk. Never delay or disregard professional advice because of something you read here, and in an emergency contact your veterinarian, physician, or local emergency services.
3. Eligibility
The Service is intended for a general adult audience. You must be at least 13 years old (and at least 16 if you are in the EEA or UK) to subscribe. If you are a minor in your jurisdiction, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
4. Subscriptions & messages
- Free service. The daily reading is offered free of charge by email or by web-push notification.
- Consent to receive messages. By subscribing, you consent to receive a recurring daily message (typically once each morning) plus occasional transactional messages (such as a confirmation or unsubscribe notice). Email subscriptions use double opt-in — you must confirm before you are added.
- Unsubscribing. You can stop at any time: click the unsubscribe link in any email, or turn off notifications on the site or in your browser/device settings. See the Privacy Policy for details.
- SMS. Text-message delivery is not currently offered. If we add it, additional SMS terms (including message-and-data-rates and opt-out keywords) and consent will apply and will be presented at sign-up.
- Availability. We may add, change, pause, or discontinue the Service or any feature at any time, and we do not guarantee uninterrupted or error-free delivery.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- submit false, fraudulent, or someone else's contact information, or sign up others without their permission;
- attempt to gain unauthorized access to, disrupt, overload, or interfere with the Service or its infrastructure;
- use bots, scrapers, or automated means to access the Service or evade our anti-abuse controls;
- copy, resell, or commercially exploit the Service or its content except as permitted in §6.
6. Intellectual property
The Off-Leash Oracle™ name and logo are trademarks of Joy, Thee & Me LLC. Unless otherwise noted, the readings, copy, page design, graphics, and original content of the Service belong to Joy, Thee & Me LLC and are protected by intellectual-property laws.
You are welcome to share individual daily readings for personal, non-commercial purposes with attribution to "The Off-Leash Oracle™." You may not otherwise copy, reproduce, distribute, or create derivative works from the Service or bulk-export its content without our written permission.
7. Third-party services & links
The Service relies on third-party providers (including Google Firebase/Cloud for storage, functions, and push delivery, and Google reCAPTCHA for abuse prevention) and may link to affiliated sites such as BindiTails and BarkParks. Your use of third-party services is governed by their own terms and privacy policies, and we are not responsible for their content or practices.
8. Disclaimers
The Service and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Joy, Thee & Me LLC disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be uninterrupted, timely, secure, accurate, or error-free.
Without limiting the above, the readings are for entertainment only and carry no warranty of accuracy, suitability, or fitness for any purpose, as described in §2.
9. Limitation of liability
To the fullest extent permitted by law, in no event will Joy, Thee & Me LLC or its owners, officers, members, employees, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of Joy, Thee & Me LLC arising out of or relating to the Service will not exceed one hundred U.S. dollars (US$100.00). Because the Service is free, some jurisdictions' consumer protections may still apply; nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Joy, Thee & Me LLC and its owners, officers, members, and contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Force majeure
We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, outages of third-party infrastructure or networks, acts of government, or other force-majeure events.
12. Dispute resolution & arbitration
Please read this section carefully — it affects how disputes are resolved.
If a dispute arises, please contact us first at hello@joytheeandme.com so we can try to resolve it informally. If we cannot resolve it within 30 days, you and Joy, Thee & Me LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not in a class, collective, or representative action. You and we waive any right to a jury trial. This section does not prevent either party from seeking relief in small-claims court for qualifying claims, or from seeking injunctive relief for intellectual-property misuse. If any part of this section is found unenforceable, the remainder will continue to apply, except that the class-action waiver is non-severable.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to §12, the parties submit to the exclusive jurisdiction of the state and federal courts located in Texas.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will increment the version number and update the Effective Date and Last Updated fields, and record the change in the Version History table below. Prior versions are preserved in our public source-control history so the exact Terms in effect on any date can be reconstructed. Your continued use of the Service after an update means you accept the revised Terms.
